Preface

Earn Mwachangu Ltd ("we," "us," or "our") provides the Earn Mwachangu mobile application (the "Application") and www.earnmwachangu.com (the "Site")—collectively referred to as the "Service." The Service allows employees to access a portion of their earned wages before their scheduled payday. By using the Service, you ("user," "employee," or "you") agree to be bound by these Terms & Conditions ("Terms").

We may update these Terms from time to time. Any modifications will be communicated via our Site or Application. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

If you do not agree to these Terms, you must immediately cease using the Service.

Entire Agreement

These Terms constitute the entire agreement between you and Earn Mwachangu Ltd and supersede all prior understandings, agreements, representations, and warranties related to the Service. No verbal or written statements outside of these Terms shall modify or supplement this agreement unless explicitly agreed upon in writing by Earn Mwachangu Ltd.

Service

Earn Mwachangu enables employees to access up to 60% of their earned wages before payday ("Employee Advances"). These advances are deducted automatically from the employee’s upcoming salary via Payroll Integration with the employer.

We do not provide loans, credit, or banking services. The Service facilitates access to wages already earned and does not constitute a lending arrangement. 

Eligibility & Registration

To use the Service, you must: 

(a) Be an active employee of a participating employer. 

(b) Be at least 18 years old. (

c) Agree to allow your employer to share payroll and employment data with us. 

(d) Register and create an account with accurate and up-to-date information.

You are responsible for maintaining the confidentiality of your account and all activities occurring under your account. You must notify us immediately if you suspect unauthorized use of your account.

User Conduct

You agree to use the Service only for lawful purposes and not to:

• Provide false or misleading information.

• Interfere with or disrupt the Service.

• Attempt to gain unauthorized access to other accounts.

• Engage in fraudulent, illegal, or abusive activities.

• Circumvent, disable, or otherwise interfere with security-related features of the Service.

Violation of these rules may result in immediate termination of your account.

Access & Availability

While we strive to ensure the availability of the Service, we do not guarantee uninterrupted or error-free access. The Service may be subject to maintenance, updates, or unforeseen technical issues. We may suspend, discontinue, or modify the Service at any time without prior notice.

Fees & Repayment

Earn Mwachangu may charge a nominal processing fee for each Employee Advance, disclosed before each transaction. This fee will be deducted alongside the advance amount on your next payday.

Failure to repay on the scheduled date due to salary shortfalls may result in account suspension and restriction from accessing further advances.

Employer Data Sharing

By using the Service, you authorize your employer to share necessary employment and payroll data with Earn Mwachangu to verify earnings and facilitate payroll deductions. We do not share or sell your data to third parties without your explicit consent.

Third-Party Links & Services

The Service may contain links to third-party websites or services. We are not responsible for the content, availability, or reliability of such external sites and do not endorse any third-party offerings. Your interactions with third parties are at your own risk.

Data Privacy

Your personal information is processed in accordance with our Privacy Policy, available at www.earnmwachangu.com/privacy. By using the Service, you consent to data collection, storage, and processing as outlined in our Privacy Policy.

Proprietary Rights

All intellectual property rights in the Service, including but not limited to trademarks, copyrights, patents, and proprietary information, belong to Earn Mwachangu Ltd. You may not use, copy, distribute, or modify any part of the Service without our prior written consent.

Limitation of Liability

To the maximum extent permitted by law, Earn Mwachangu Ltd shall not be liable for any indirect, incidental, punitive, or consequential damages resulting from your use of the Service. Our total liability, in any case, shall not exceed the total fees paid by you for the Service in the preceding three (3) months.

Dispute Resolution

Any disputes arising from these Terms shall first be attempted to be resolved through informal negotiations. If unresolved, disputes shall be settled through binding arbitration in accordance with the laws of [Country of Operation]. The arbitration process shall be confidential and conducted by a single arbitrator.

Governing Law

Modifications to or Discontinuation of Service

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

Consent to be Contacted

By using the Service, you consent to receive communications from Earn Mwachangu Ltd via email, SMS, phone calls, or push notifications for account-related matters and promotional purposes. You may opt out of marketing communications at any time, but essential service-related communications will still be sent.

Termination

We reserve the right to terminate or suspend access to the Service at our discretion if we detect fraud, misuse, or violations of these Terms. Upon termination, all pending obligations, including repayments, shall remain enforceable.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free.
